Terms of Service
1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and Boat Dog Customs LLC, a Virginia limited liability company ("TSPRO," "we," "us," or "our"), governing your access to and use of the TeamSchedulePro website and application (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a facility, league, or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use of your account.
3. The Service
TSPRO is a tool that generates and manages sports-league schedules based on the divisions, teams, surfaces, availability, and requests you provide. We may add, change, or remove features of the Service at any time.
4. Your data and content
As between you and us, you retain all rights to the information you enter into the Service (your "Content"), including team names, coach information, divisions, surfaces, availability, and requests. You grant us a limited license to host, process, and use your Content solely to operate and provide the Service to you.
You are responsible for your Content, including having the necessary rights to provide any information you enter (such as coach contact details) and for ensuring it does not violate any law or third-party right. You acknowledge that the Service is not designed to store player rosters and you agree not to attempt to use it to store personal information about individual players or minors.
5. Credits, pricing, and payment
Credit model. The Service operates on credits. Building schedules, setting up your facility, leagues, and seasons, and running the scheduler are free. Publishing a finished game to your calendar costs one (1) credit. Current per-credit pricing, volume discounts, and any minimum purchase are shown on the Service at the time of purchase; the price and total shown at checkout apply to your order.
Credits do not expire. Purchased credits remain available in your account until used, and are not subject to any "use it or lose it" time limit.
Payment. Payments are processed by our third-party payment processor, Stripe. By purchasing credits, you authorize us and Stripe to charge your selected payment method for the amount shown at checkout. You are responsible for any applicable taxes.
Refunds. Except where required by law, credit purchases are non-refundable. Because purchased credits never expire, unused credits remain in your account for future use rather than being refunded. We may, in our sole discretion, issue refunds or credit adjustments in individual cases.
6. Acceptable use
You agree not to:
- Use the Service in violation of any law or regulation, or for any unlawful or fraudulent purpose;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, decompile, copy, or create derivative works of the Service, except to the extent this restriction is prohibited by law;
- Resell, sublicense, or provide the Service to third parties except as expressly permitted; or
- Use the Service to store or transmit personal information about individual players or minors.
7. Intellectual property
The Service, including its software, scheduling engine, design, text, and branding (including the "TeamSchedulePro" and "TSPRO" names), is owned by Boat Dog Customs LLC and is protected by intellectual property laws. These Terms do not grant you any ownership of the Service. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.
8. Service availability
We aim to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at any particular time. We may suspend or limit access for maintenance, updates, or reasons outside our control.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SCHEDULE PRODUCED BY THE SERVICE WILL BE FREE OF ERRORS OR SUITABLE FOR YOUR PARTICULAR NEEDS. YOU ARE RESPONSIBLE FOR REVIEWING SCHEDULES BEFORE RELYING ON OR PUBLISHING THEM.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOAT DOG CUSTOMS LLC AND ITS OWNERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR CREDITS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Boat Dog Customs LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your Content, your use of the Service, or your violation of these Terms or any law or third-party right.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service or others. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. You agree that any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Virginia, and you consent to the jurisdiction of those courts.
